Documents Required to transfer Land Ownership in Kenya

  4. Rates clearance certificate obtained from the county government confirming there are no outstanding land rates.
  5. Land rent clearance certificate obtained from the Ministry of Lands, applicable for leasehold land, also confirming no rent arrears.
  6. Spousal consent (if applicable) which is a signed affidavit or consent letter where matrimonial property is involved.
  7. Copy of seller’s identification documents national ID/passport and KRA PIN certificate.
  8. Copy of seller’s passport photo.
  9. Succession documents where the land is inherited, a grant of probate/letters of administration confirming the seller has legal authority to sell.

From the Buyer (Purchaser):

  2. Passport photos.
  3. Evidence of payment of stamp duty assessed and paid via the iTax/Ardhisasa system based on the property’s value.
  4. Signed transfer instrument (counter-signed as the transferee).

Other supporting documents are:

  • Sale agreement – the original contract, signed and witnessed, often by an advocate for both parties.
  • Valuation report – used for stamp duty assessment.
  • Land search certificate – confirming the current state of the title.
  • Consent to transfer (from relevant authority, e.g., Commissioner of Lands, for leasehold government land or the County Land Control Board for freehold/agricultural land).

Once these documents are lodged with the Land Registry (or via Ardhisasa), the transfer is registered and a new title issued to the buyer.
